這個缺陷值多少錢?這個缺陷寫錯了?!

今天想說兩個問題:一個是兩個缺陷值多少錢,一個是PSCO缺陷開錯了。先看下香港PSCO4月份滯留的這艘船舶。

船名:HAI NAM STAR  

IMO號:9545742

管理公司:Hai Nam Development & Investment JSC (Cong Ty Co Phan Dau Tu Va Phat Trien Hai Nam)

滯留時間:4月4日至18日,共計14天

滯留缺陷:

1、pollution prevention: since june 2014, vessel crew have only been recording manual collection of waste oil in the sludge tank and have not accounted for quantities from purifiers and other sources in the oil record book. on average vessel declares increase of 10 liters in sludge r.o.b. every two weeks. the current amount of sludge on board (4.9m3) does not match the amount stated in the last entry of the oil record book (2.3m3). there is no record of disposal of waste oil since jan 2015. recorded quantities of sl, 根據(jù)油類記錄簿的記載,自2014年6月起,船員使用手動收集的方式處理廢油,沒有計算分油機和其他方式產(chǎn)生的廢油量。油類記錄薄顯示每兩周,廢油產(chǎn)生量為10L。油渣柜的廢油量為4.9立方米,油類記錄薄未2.3立方米,兩個數(shù)據(jù)不一致。油類記錄薄,自2015年一月開始沒有油渣柜的記錄;

2、pollution prevention: vessel crew have only been recording transfers of 40 liters from bilge wells to bilge tank approximately once every 3 weeks. this does not correspond to the actual observed conditions of the vessel. multiple leaks were observed in the e/r and all bilge wells had continuous water ingress. no record of the oil filtering equipment was found since jan 2017. the actual quantity retained in bilge tank (2.5m3) does not match the quantity last recorded in the oil record book (1.7m3).,船員記錄每三周向污水艙駁運40L污水井污水,這和船上的實際情況不符,據(jù)觀察,該輪機艙部位漏水嚴重。自2017年1月沒有油水分離器的使用記錄,污水柜實際量為2.5立方米,油類記錄薄記錄為1.7立方米,兩者不匹配;

3、 ISM: def. no. 8,9 and 10 are indicative of the sms's systemic failure of vessel's and company staff to comply with marpol regulations and prevent pollution.,根據(jù)第8、9、10項缺陷顯示,公司體系失效,公司相關人員未遵守marpol公約相關規(guī)定

4、 ISM: def 8 and 9 shows tha the vessel's sms has failed to provide/ensure correct operation procedures are followed in order to ensure compliance with marpol regulations.第8、9項缺陷顯示,船舶SMS體系未確保船舶有效執(zhí)行Marpol公約。

第一、缺陷值多少錢

四個滯留缺陷,第1、第2個屬于油類和污水記錄與實際不符,按照我朝法律是要罰款的,可能存在兩項違法事實

1、船舶污染物處置記錄與船舶產(chǎn)生的污染物數(shù)量不符合

2、船舶向海域排放禁止排放的污染物

按照《防治船舶污染海洋環(huán)境管理條例》第五十九條。 《中華人民共和國海上海事行政處罰規(guī)定》第八條第一款?!吨腥A人民共和國海上海事行政處罰規(guī)定》第九條第一款的處罰強度罰款金額在20000到100000元之間。如果持續(xù)的調(diào)查顯示非法排污,處罰金額可搞到200000元。香港自然屬于我國,罰與沒罰不曉得啦

第二PSCO缺陷開錯了

第3和第4個缺陷同為ISM體系缺陷,兩個缺陷的意思幾乎相同,PSCO的本意是想開一個公司體系失效缺陷,開一個船舶體系失效缺陷,但是IMO沒有賦予PSCO那大權力,PSCO僅僅是檢查船舶當時的狀況,并不是對船舶體系的審核。曾經(jīng)推送過一期關于ISM體系缺陷的文章,種種壓力,不得己刪除了,收藏的朋友可以自己找來看。

按照IMO發(fā)布的A.1119(30) APPENDIX 8 的要求:

7 FOLLOW-UP ACTION

Note: Where the PSCO considers one or more technical and/or operational deficiency(s) is ISM-related this should be recorded as only one ISM deficiency.”

當PSCO認定一個或者多個技術性和(或)操作性缺陷與ISM相關時,應當只作為一個ISM缺陷記錄。
