一、什么叫風(fēng)險(xiǎn)代理、什么是風(fēng)險(xiǎn)代理?

1.風(fēng)險(xiǎn)代理，通俗的理解就是律師在幫當(dāng)事人打贏官司后當(dāng)事人再支付律師代理費(fèi)。

2.風(fēng)險(xiǎn)代理收費(fèi)是指律師事務(wù)所在接受委托時，只收取基礎(chǔ)費(fèi)用，其余服務(wù)報(bào)酬由律師事務(wù)所與委托人就委托事項(xiàng)應(yīng)實(shí)現(xiàn)的目標(biāo)、效果和支付律師服務(wù)費(fèi)的時間、比例、條件等先行約定。

3.達(dá)到約定條件的，按約定支付費(fèi)用;不能實(shí)現(xiàn)約定的，不再支付任何費(fèi)用。

4.2006年4月13日《律師服務(wù)收費(fèi)管理辦法》正式確認(rèn)風(fēng)險(xiǎn)收費(fèi)是律師收費(fèi)的一種方式，確認(rèn)律師風(fēng)險(xiǎn)收費(fèi)的合法性。

二、律師風(fēng)險(xiǎn)代理規(guī)定、哪些案件不能風(fēng)險(xiǎn)代理?

1.禁止刑事訴訟案件、行政訴訟案件、國家賠償案件以及群體性訴訟案件實(shí)行風(fēng)險(xiǎn)代理收費(fèi)。

2.律師辦理涉及財(cái)產(chǎn)關(guān)系的民事案件時，委托人被告知政府指導(dǎo)價(jià)后仍要求實(shí)行風(fēng)險(xiǎn)代理的，律師事務(wù)所可以實(shí)行風(fēng)險(xiǎn)代理收費(fèi)，但下列情形除外：

1)婚姻、繼承案件;

2)請求給予社會保險(xiǎn)待遇或者最低生活保障待遇的;

3)請求給付贍養(yǎng)費(fèi)、撫養(yǎng)費(fèi)、扶養(yǎng)費(fèi)、撫恤金、救濟(jì)金、工傷賠償?shù)?

4)請求支付勞動報(bào)酬的。

三、風(fēng)險(xiǎn)代理費(fèi)、律師風(fēng)險(xiǎn)代理收費(fèi)標(biāo)準(zhǔn)?

1.實(shí)行風(fēng)險(xiǎn)代理收費(fèi)，律師事務(wù)所應(yīng)當(dāng)與委托人簽訂風(fēng)險(xiǎn)代理收費(fèi)合同，約定雙方應(yīng)承擔(dān)的風(fēng)險(xiǎn)責(zé)任、收費(fèi)方式、收費(fèi)數(shù)額或比例。

2.實(shí)行風(fēng)險(xiǎn)代理收費(fèi)，最高收費(fèi)金額不得高于收費(fèi)合同約定標(biāo)的額的30%。

四、風(fēng)險(xiǎn)代理與傳統(tǒng)代理區(qū)別?

1.風(fēng)險(xiǎn)代理的對象多是疑難復(fù)雜，特別是執(zhí)行難度比較大的案件，否則委托人不會同意風(fēng)險(xiǎn)代理。

2.風(fēng)險(xiǎn)代理結(jié)果與律師報(bào)酬及投資回收密切聯(lián)系，即律師不僅要承擔(dān)收不到代理費(fèi)的風(fēng)險(xiǎn)，還要承擔(dān)投資損失的風(fēng)險(xiǎn)，這促使辦案律師不得不加強(qiáng)責(zé)任心。

3.風(fēng)險(xiǎn)代理約定的收費(fèi)比例比較高，對律師的吸引力比較大。

4.委托人對承辦律師的信任度高，律師對案件實(shí)體權(quán)益的處分權(quán)限比較大。

五、律師風(fēng)險(xiǎn)代理合同書、風(fēng)險(xiǎn)代理合同范本、律師風(fēng)險(xiǎn)代理協(xié)議書?

風(fēng)險(xiǎn)代理合同

因我(甲方)與____糾紛一案，委托____律師事務(wù)所(乙方)的律師代理訴訟，經(jīng)雙方協(xié)議，訂立下列各條，共同遵照執(zhí)行：

1.乙方接受甲方的委托，指派___律師為訴訟代理人。

2.乙方律師必須認(rèn)真履行代理職責(zé)。

3.甲方必須真實(shí)地向律師敘述案情，提供本案證據(jù);乙方接受委托后，發(fā)現(xiàn)甲方捏造事實(shí)，弄虛作假，有權(quán)終止代理，依約所收費(fèi)用不予退還。

4.如乙方無故終止合同，代理費(fèi)全部退還甲方;如甲方無故終止，代理費(fèi)不退還。

5.甲方委托乙方代理權(quán)限：特別授權(quán)。

6.根據(jù)雙方達(dá)成的風(fēng)險(xiǎn)代理協(xié)議，甲方首先支付乙方基本代理費(fèi)___元，待與對方達(dá)成和解、調(diào)解或判決后，按甲方實(shí)際從對方取得的賠償款項(xiàng)的__%，減去已付的基本代理費(fèi)___元向乙方支付風(fēng)險(xiǎn)代理費(fèi)，支付時間為取得賠償款后即時給付。

7.本合同簽定時乙方已告知甲方相關(guān)訴訟風(fēng)險(xiǎn)。

8.本合同有效期，自簽字之日起至執(zhí)行終結(jié)止。

9.如一方要求變更合同條款，需再行協(xié)議。
